Federal Judge Blocks Obama Amnesty / Immigration Orders; Senate Dems Should "End Partisan Filibuster" Of DHS Funding

No Congress is not back in session. They are still in their districts for work period. Hope voters will speak to their Senators and Representatives on their issues of concern.
The Senate will return for legislative business on Monday, February 23rd. At 5:30 on the 23rd, the Senate will again vote on cloture on the motion to proceed to H.R. 240, the House-passed Homeland Security appropriations bill. Senate Democrats have prevented the Senate from taking up the bill three times now. It is time for them to stop selling a false narrative. The house bill FULLY funds DHS. It does not legalize and fund the Presidents proposed Amnesty plan. Democrats for some reason intent on not voting on the DHS funding bill in hopes that a shutdown will force the House to agree to President Obama Amnesty. In addition, they are unwilling to offer vote to proceed to the bill and then to offer Amendments to fund the President's program of Amnesty for illegals because they know they have abused the Senate for so long that their amendments will be voted down. In stead, Democrats believe the liberal media, and some instances FoxNews, will advance their false rhetoric that it is the Republicans who have shut down DHS.
Time to talk to your Democrat Senators and tell them to stop playing around with the fully funded DHS bill and to stop supporting Amnesty for Illegals.
The Washington Post reported yesterday, “A federal judge in Texas last night temporarily blocked the Obama administration’s executive actions on immigration. The judge, responding to a suit filed by 26 Republican-run states, did not rule on the legality of immigration orders but said there was sufficient merit to the challenge to warrant a suspension while the case goes forward. No law gave the administration the power ‘to give 4.3 million removable aliens what the Department of Homeland Security itself labels as “legal presence,”’ the judge said in a memorandum opinion. ‘In fact the law mandates that these illegally-present individuals be removed.’ The Department of Homeland Security ‘has adopted a new rule that substantially changes both the status and employability of millions.’ . . .
“The administration’s directives announced in November have been vigorously challenged by Republicans in Congress and across the country, who cite them as examples of what House Speaker John A. Boehner (R-Ohio) has called Obama’s ‘legacy of lawlessness.’”
The Wall Street Journal editors describe this “rebuke” to the White House: “[Judge Andrew Hanen’s] meticulous 123-page ruling is a vindication of the 26 states that brought the challenge and, more significantly, for the rule of law. . . . As he points out, the DHS memos amount to ‘a massive change in immigration practice’ that reorders ‘the nation’s entire immigration scheme.’ Instead of the historical norm of forbearance in individual cases, the memos devote 150 pages to detailing a blanket policy for whole classes of immigrants—meaning that discretion is ‘virtually extinguished,’ as Judge Hanen writes. The memos also actively bestow benefits that Congress never granted, such as the right to work, obtain Social Security numbers, and travel to and from the U.S. . . .
“‘If one accepts the Government’s position,’ Judge Hanen observes, ‘then a lack of resources would be an acceptable reason to cease enforcing environmental laws, or the Voting Rights Act, or even the various laws that protect civil rights and equal opportunity. Its argument is that it has the discretion to cease enforcing an act as long as it does so under the umbrella of prosecutorial discretion.’”
The policies of DHS are also threatening legal Americans via orders to Border Patrol agent to not due their duty on and near the border. As one illustration, last week Judicial Watch reported on "The Obama administration has ordered federal agents responsible for protecting one of the nation’s busiest and most crime-infested regions near Mexico to stop apprehending drunk drivers, according to an internal government memo that also concedes an officer that elects to detain them is 'acting within the course and scope of his employment.' ... This preposterous order has not been well received by agents, according to Judicial Watch’s sources inside the agency."
A WSJ news report adds, “Congressional Republicans Tuesday applauded a federal judge in Texas’s order late Monday temporarily blocking implementation of President Barack Obama’s decision last year to shield millions of illegal immigrants from deportation. Top Republicans said the Texas injunction validated their concerns that Mr. Obama’s executive action on immigration overstepped his legal bounds. GOP lawmakers have made overturning the immigration action one of their top priorities and have said they won’t extend funding for the Homeland Security Department, which oversees immigration, unless it is reversed.
“‘The president said 22 times he did not have the authority to take the very action on immigration he eventually did, so it is no surprise that at least one court has agreed,’ House Speaker John Boehner (R., Ohio) said in a statement Tuesday closely mirrored by one from Senate Majority Leader Mitch McConnell (R., Ky.).’”
Leader McConnell said, “This ruling underscores what the President has already acknowledged publicly 22 times: He doesn’t have the authority to take the kinds of actions he once referred to as ‘ignoring the law’ and ‘unwise and unfair.’ Senate Democrats--especially those who've voiced opposition to the President’s executive overreach—should end their partisan filibuster of Department of Homeland Security funding.”

Well, duh! Even Obama said over 20 times that he didn't have the authority under the constitution to do this. WOOT! WOOT!
