Senate Set To Vote On Blocking Obama EPA's Costly Anti-Coal Carbon Regulations

Today in Washington, D.C. - Nov. 17, 2015
The House Reconvened today at 10 AM and then recessed until Noon when it reconvened for business.
Bills which may be considered today:
H.R. 1737 - "To nullify certain guidance of the Bureau of Consumer Financial Protection and to provide requirements for guidance issued by the Bureau with respect to indirect auto lending;."
H.R. 511 - "To clarify the rights of Indians and Indian tribes on Indian lands under the National Labor Relations Act; and for other purposes."
H.R. 1694 — "To amend MAP-21 to improve contracting opportunities for veteran-owned small business concerns, and for other purposes."
H.R. 3114 — "To provide funds to the Army Corps of Engineers to hire veterans and members of the Armed Forces to assist the Corps with curation and historic preservation activities, and for other purposes."
H.R. 511 — "To clarify the rights of Indians and Indian tribes on Indian lands under the National Labor Relations Act."
H. Res. 524"Condemning in the strongest terms the terrorist attacks in Paris, France, on November 13, 2015, that resulted in the loss of at least 129 lives."

Bill passed yesterday: All are voice vote unless noted.
H.R. 1073 — "To amend the Homeland Security Act of 2002 to secure critical infrastructure against electromagnetic threats, and for other purposes."
H.R. 1317 — "To amend the Commodity Exchange Act and the Securities Exchange Act of 1934 to specify how clearing requirements apply to certain affiliate transactions, and for other purposes."
H.R. 1338 (409-0) — "To require the Secretary of Veterans Affairs to conduct a study on matters relating to the burial of unclaimed remains of veterans in national cemeteries, and for other purposes."
H.R. 1384 (407-0) — "To amend title 38, United States Code, to recognize the service in the reserve components of certain persons by honoring them with status as veterans under law."
H.R. 1478 — "To provide for notice to, and input by, State insurance commissioners when requiring an insurance company to serve as a source of financial strength or when the Federal Deposit Insurance Corporation places a lien against an insurance company's assets, and for other purposes."
H.R. 3032 — "To amend the Securities Exchange Act of 1934 to repeal a certain reporting requirement of the Securities and Exchange Commission."
H.R. 3144 — "To require consultation with the Aviation Security Advisory Committee regarding modifications to the prohibited item list, require a report on the Transportation Security Oversight Board, and for other purposes."
H.R. 3996 — "To provide an extension of Federal-aid highway, highway safety, motor carrier safety, transit, and other programs funded out of the Highway Trust Fund, and for other purposes."

Speaker Paul Ryan (R-WI) today appointed 10 House Republicans to serve on a conference committee for legislation to reauthorize the Elementary and Secondary Education Act.

“By returning power to states and school districts, we can give parents more choices and make sure students get the skills they need,” Speaker Ryan said. “I commend Chairman Kline for his hard work on this issue, and I look forward to reviewing the final agreement.”

The Senate reconvened today at 10 AM and observed a moment of silence for the victims of the Paris terrorist attacks.

Following an hour of morning business, the Senate agreed by voice vote to the motion to proceed to S.J. Res. 24, the resolution under the Congressional Review Act (CRA) disapproving of the EPA’s costly carbon emission rules for power plants.

The Senate then began consideration of S.J. Res. 24, which is sponsored by Sen. Shelley Moore Capito (R-WV) and Sen. Heidi Heitkamp (D-ND).

A vote on this resolution and on another disapproving of the EPA’s carbon regulations for new power plants offered by Senate Majority Leader Mitch McConnell are likely this afternoon.

Yesterday, the Senate voted 93-1 to confirm LaShann Hall to be US District Judge for the Eastern District of New York.

Also yesterday Leader McConnell filed for cloture on the motion to proceed to H.R. 2577, the Fiscal Year 2016 Transportation and Housing and Urban Development (THUD) appropriations bill.

Today, Americans for Limited Government (ALG) President Rick Manning today urged the U.S. Senate to adopt an amendment expected to be introduced by Sen. Mike Lee (R-Utah) that would deny funds to implement the rule "Affirmatively Furthering Fair Housing" by the Department of Housing and Urban Development (HUD):"Sen. Mike Lee deserves the thanks of the American people for again proposing an amendment to defund HUD's attempts to rezone any municipality that accepts any part of the $3.5 billion a year in community development block grants from the federal government. The Obama administration is engaged in a utopian plan to create evenly distributed neighborhoods based on racial composition and income. It is social engineering at its worst, and a back-door attempt to gerrymander districts.

"It is also unconstitutional. Under principles of federalism, zoning is left up to states, counties and municipalities to determine for themselves. HUD has no place in drawing up neighborhoods based on racial preferences. In addition, the HUD rule will do nothing to stop individual cases of housing discrimination based on race that have been illegal since the 1960s.

"Americans for Limited Government strongly supports the Lee amendment to defund Obama's racial zoning quotas, and urges it be included in any upcoming omnibus spending legislation for the remainder of Fiscal Year 2016. Companion legislation by Rep. Paul Gosar has already been included in the Transportation and HUD appropriations bills that passed the House of Representatives in 2014 and 2015. It's time it be included in Senate appropriations as well."
Yesterday, ALG urging both chambers of Congress to take up legislation blocking the unionization of the Internal Revenue Service (IRS) by U.S. Rep. Paul Gosar (R-Ariz.) and Sen. Cory Gardner (R-Colo.):"Senator Cory Gardner and Representative Paul Gosar deserve the nation's thanks for their efforts to keep the IRS free from undue public employee union influence.

"At a time when the IRS is engaged in open political warfare against the tea party and other conservative non-profits, Congress has the ability to depoliticize the agency in one small way — by blocking any unionization of this civil service agency. No political organizations, including unions, should have undue influence inside an agency as powerful as the IRS, and the Gosar-Gardner bill addresses that danger head on.

"We urge every member of Congress to cosponsor and help secure passage of this non-controversial, non-partisan stance against politics corrupting the IRS. Nobody liked it when Nixon used the IRS against his political enemies, and this should be no different."
Speaking on the floor this morning, Senate Majority Leader Mitch McConnell said, “The Obama Administration is trying to impose deeply regressive energy regulations that would eliminate good-paying jobs, punish the poor, and make it even harder for Kentuckians to put food on the table.

“Their effect on global carbon levels? Essentially a rounding error. Their effect on poor and Middle-Class families? Potentially devastating.

“And yet. The deep-pocketed left-wingers who increasingly call the shots in the Obama White House don’t seem to care. Just like with its decision on Keystone last month, the Obama Administration is putting facts and compassion to the side in order to advance their ideological agenda.

“Higher energy bills and lost jobs may be a mere trifle to some on the Left, but it’s a different story for millions of Middle-Class Americans . . . .

“Senators from both parties are saying that we should be standing up for the Middle Class instead. That’s why we’ve joined together to work toward overturning these two-pronged regulations.

“I’m happy to report that the bipartisan measures we filed last month to overturn those regressive regulations have now been made available for consideration by the full Senate.

“The first measure pertains to regulations on existing energy sources, while the second pertains to regulations on new sources. Together, they represent a comprehensive solution.”

The Hill reports, “The Senate will vote as early as this week to block President Obama’s climate change rules for power plants. . . .

“The legislation only requires a simple majority vote, which would fulfill one of McConnell’s top priorities and promised to his constituents: to block the rules, which are due to hit the coal industry especially hard.

“‘These regulations make it clearer than ever that the president and his administration have gone too far, and that Congress should act to stop this regulatory assault,’ McConnell said in a statement. ‘Here’s what is lost in this administration’s crusade for ideological purity: the livelihoods of our coal miners and their families. Folks who haven’t done anything to deserve a ‘war’ being declared upon them.’

“The regulations were made final in August by the Environmental Protection Agency, and are the main pillar of Obama’s second-term push against climate change. . . .

“‘The administration bypassed Congress entirely when it developed this rule, and these resolutions of disapproval will give senators an opportunity to approve or disapprove of these far-reaching regulations,’ Sen. Shelley Moore Capito (R-W.Va.), who sponsored the resolution for the existing-plant rule, said in a statement.

“Sen. Heidi Heitkamp (D-N.D.) is also sponsoring Capito’s legislation, and Sen. Joe Manchin (D-W.Va.) is sponsoring McConnell’s.”

Thus, there is bipartisan support for overturning these costly regulations that will raise energy bills and eliminate many jobs.

While Obama administration officials have boasted that “a war on coal is exactly what's needed” and that “you make examples out of people,” residents of coal country say, “we’re people, too.”

One coal miner said, “Our biggest worries now are just trying to keep a roof over our heads, food on the table, telling your family that this was all caused by the EPA, directed by our President for his political agenda.”

Another told Fox News, “I just believe the Obama administration has taken a huge impact on the coal industry and Appalachia. Anymore, you just never know from day to day if you are going to have a job or not.”
