Activist Judges Taking Cues From the ACLU
For years, conservatives have argued that activist judges take their cues from the ACLU. Now there's evidence that courts are taking more than cues. Last year federal Judge John Jones, who issued a long, sweeping opinion striking down Dover, Pennsylvania's policy on teaching about the evolution and intelligent design controversy, has been accused of stealing actual pages from ACLU briefs. The Discovery Institute study found that 90.9% of the 6,004-word "Findings of Fact and Conclusions of Law" from the ACLU lawyers appeared in the ruling. Also, that Jones reprinted a number of factual errors in his ruling that have since been retracted by the ACLU. This same Judge Jones has been hailed for his "masterful" opinion and lauded as "an outstanding thinker." Even Time magazine honored him as "one of the world's 'most influential people' in the category of 'scientists and thinkers.'" In the last four decades, some American courts have become little more than puppets of the political left. We shouldn't be surprised that these judges are bench warmers for activists--nominated not for their ability to think critically and interpret the law but for their ability to "cut and paste" from a liberal agenda.Read A Comparison of Judge Jones' Opinion in Kitzmiller v. Dover with Plaintiffs' Proposed "Findings of Fact and Conclusions of Law"
2/3rds of federal judges are GOP appointees! The ACLU is full of lawyers and plenty of judges, just as there are many that are members of conservative groups. In the Dover case the judge agreed with the ACLU's position, so of course his decision will look like their position! Why do you guys play this sleazy game? The ACLU exists to protect the Bill of Rights - even when it's unpopular. It's easy to scapegoat the ACLU, trial lawyers, the UN, contractors, etc - but we need these people to maintain a healthy republic. CAn't you see the damage you are doing here?
Jersey, First, thanks for reading and commenting. Hope you took the opportunity to read the full report. Obvious this post were words from the cited source quoting a study of a Judge's plagiarism.
Unfortunately, we must agree to disagree with respect to the ACLU. I wish the ACLU was supporting a healthy republic but unfortunately, it does not. It repeatedly takes action to take away freedoms of the majority in the republic and to impose the position of the few within the republic.
It also continues to take actions to hamper us as a free republic and to integrate us into being controlled by the dictates of other countries especially via the UN.
Finally, this posting was about the judge more than the ACLU which can be expected to advance its own positions even though they too often take away our “civil liberty.” The posting concerned an activist judge praised for his ability to be an “an outstanding thinker" who in fact failed to evidence independence in his thinking or the ability to express his own opinion in most of the words he used. If either of us were to plagiarize, 90.9 % of the words from anyone else's position in setting forth our position in a justification or article without officially giving credit , we would be identified as something more than biased – we would be called thieves and not free thinking. I will agree that we need to call all judges into accountability and exercise the “impeachment” process more for judges.
As an “information” blog, verses a “individual expressive” blog, we mostly post the words of others – yes often chosen based on our own bias. We post the referenced sources so people can go to the original source and decide for themselves.
