BUSTED: GAO Calls Out Great Obamacare Heist
House Energy & Commerce Committee: A legal opinion issued by the nonpartisan government watchdog, the Government Accountability Office (GAO), yesterday concluded that “HHS may not use amounts collected for the Treasury to make reinsurance payments.” The ruling is a blow to the administration, which has been using taxpayer dollars to make the unlawful payments to insurers for the last two years in an attempt to prop up the president’s failing health care law.
Committee leaders issued a subpoena this summer after continued stonewalling for the most basic information about the payments. And after multiple nonpartisan groups called out the administration’s new interpretation of the plain language of the law, they are doubling down on the legitimacy of the payments.
The committee has called on the administration to stop the illegal payments and pay back the American taxpayer.

The Obama administration failed to follow the president's health care law in a $5 billion dispute over compensating insurers for high costs from seriously ill patients, Congress' investigative arm said Thursday.
The opinion from the Government Accountability Office is a setback for the White House and bolsters Republican complaints that administration officials bent the law as problems arose carrying out its complex provisions. Watchdog knocks administration for misusing Obamacare funds

The Obama administration is illegally sending payments to health insurers instead of to the federal Treasury as Obamacare requires, according to a new report from the Government Accountability Office.
The congressional auditor's report focuses on how the government handles fees paid by insurers for Obamacare's reinsurance program, which collects money from all health plans to help insurers cover the cost of sicker patients in the health care law's exchanges.
In 2014, the industry-funded reinsurance program was supposed to provide $10 billion to insurers and $2 billion to the federal Treasury. But when total collections from insurers amounted to only $9.7 billion, the Department of Health and Human Services opted to funnel all of the money toward insurers. The agency paid insurers $7.9 billion in claims for 2014, the first year of exchange coverage, and held over the remaining $1.7 billion for future payments. …

The Obama administration is illegally refusing to make payments to the U.S. Treasury and instead giving funds collected under Obamacare to insurers, according to a new report from an independent government watchdog.
The administration disagrees with the findings.
The funds in question were collected as part of Obamacare’s reinsurance program, one of three programs included in the health care law to reduce risk for insurers participating on exchanges. Siding with Republicans who have been investigating the program, the Government Accountability Office said Thursday that the law mandates that some of the money collected must be deposited into federal coffers.
“We expect the administration to comply with the independent watchdog’s opinion, halt the billions of dollars in illegal Obamacare payments to insurers, and pay back the American taxpayers what they are owed,” said a spokeswoman for the Energy and Commerce Committee Republicans. …
